What is the Housing Development Agency Act No 23 of 2008?

The Housing Development Agency Act No 23 of 2008: This Act defines the HDA’s mandate roles and functions. It also makes provision for the HDA to expedite the processes of housing development by overcoming delivery challenges across all spheres of government.

Overview of the Rental Housing Act in South Africa

Its primary goal is to ensure fair and equitable treatment for both parties, as well as to promote responsible renting practices. Under this act, both landlords and tenants have specific rights and responsibilities that must be adhered to.

Section 13 deals with complaints to the Tribunal. The Tribunal must within 30 days of receipt of a complaint refer any matter that relates to eviction to a competent court.

Landlords are not allowed to cut off essential services such as electricity or water, even if the tenant is behind on rent. Tenants have a legal right to access these services, and landlords must follow the appropriate legal procedures to address overdue payments.
